Possible suspension or revocation of a Hackney Carriage Driver's Licence

The Sub-Committee was required to consider what enforcement action should be taken against a Hackney Carriage Driver who had contravened the provisions of the Local Government (Miscellaneous Provisions) Act 1976 and the Gravesham Hackney Carriage and Private Hire Policy.
Local authorities are able to take action against drivers whose conduct is unacceptable under section 61 of the Act.
The Sub-Committee was informed that the Hackney Carriage Driver had been found guilty of fraudulently claiming Housing Benefit and Council Tax contrary to section 121(1A) of the Social Security Administration Act 1992
The Borough Council had not suspended the Driver as they did not consider that he posed a risk to the travelling public by his offence.
The Senior Licensing Officer apprised the Sub-Committee of the Hackney Carriage Driver’s record.
The Sub-Committee adjourned to consider its decision.
Resolved that six penalty points be put on the Hackney Carriage Driver’s Licence for a period of 24 months from the date of the meeting (10 December 2010).
